Given the pending issuance of the final rule modifying HIPAA and the requirement that HIEs develop business associate contracts, HIEs will be required to consult with their counsel to determine the third party relationships that do not require business associate contracts and to be advised on the impacts upon their various contractual relationships and inter policies' and procedures' compliance.
